CNN, MS NOW and Politico have sued President Donald Trump and members of his administration after being barred from the White House, opening another legal fight over presidential press access and the First Amendment.
The three outlets filed the lawsuit in federal court in Washington, D.C., on Monday and are seeking a temporary restraining order that would block the ban. A hearing is scheduled for Wednesday.
The CNN MS NOW Politico sue Trump White House ban case follows Trump’s decision to exclude the outlets after accusing them of publishing what he called “fake news” and “fiction and lies.”
The White House has defended the restrictions, saying access is a privilege rather than a right.
The dispute has quickly expanded beyond the three organizations. CNN is one of five broadcasters that form the primary White House television pool which shares footage of presidential events with other news organizations.
After CNN was unable to provide coverage from Trump’s New York trip for the UN General Assembly, the other networks suspended pool coverage rather than replace it.

Why the Ban is Now in Court
The outlets argue that the Trump White House press ban First Amendment challenge concerns the government restricting access because of the content of their reporting. The White House Correspondents Association has supported the affected journalists, saying access cannot be denied arbitrarily or because officials dislike coverage.
The press freedom lawsuit 2026 has been assigned to US District Judge Timothy Kelly, who was appointed by Trump in 2017. Kelly previously ruled against the administration in the 2018 dispute involving CNN correspondent Jim Acosta, when the White House had revoked Acosta’s press credentials.
What the Acosta Case Shows
The earlier case is relevant because it demonstrates why disputes over White House access can quickly become constitutional litigation. A federal judge ordered Acosta’s hard pass restored after the administration revoked it following a confrontation during a Trump news conference.
The Trump, media ban court hearing on Wednesday will determine an early stage of the latest dispute, not the final outcome. Its significance will depend on how the court assesses the administration’s reasons for excluding the outlets and the constitutional arguments raised by the news organizations.
