Data Protection Commission, an Irish data protection authority, has initiated an official European Union investigation into Grok, the artificial intelligence chatbot built into X, on the issue of sexualized AI generated images.

The regulator indicated that the investigation will look to find out whether the image-generation functionalities of Grok are in line with the EU General Data Protection Regulation (GDPR). The inquiry will determine whether the personal data might have been handled illegally by the system to generate some pictures, including those that may portray recognisable figures.

Grok is created by X, a social media platform owned by Elon Musk. The chatbot is able to react to user inputs and generate text and images. The regulators are also considering whether its outputs can affect the privacy rights based on EU law, especially where explicit or manipulated images are used.

The companies in the European Union under GDPR have to comply with the law to make sure that personal information is processed in a legal manner and the personal rights of people are not violated. The regulator in Ireland is spearheading the investigation since the headquarters of X is located in Dublin, which means that the DPC has the major responsibility of oversight in the bloc.

The investigation follows larger regulatory scopes of AI systems that can produce deepfakes, realistic and fake images or videos generated with the help of artificial intelligence. The European authorities have expressed concerns about the risks that such tools can pose to privacy and consent.

The DPC declared that it will establish whether or not X has fulfilled its duties under GDPR concerning Grok image features. In case of breaches, the regulator can seek corrective actions or financial fines.

X has not made publicly detailed statements on the investigation.
