A legal battle has reached closure between Elon Musk’s X Corp, SpaceXAI and Apple over antitrust claims regarding Apple’s partnership with OpenAI and differences in the AI chatbot market.
The two companies requested to dismiss their claims against Apple in a court filing on Monday. The filing gave no reason for the decision, or whether Apple had settled with companies run by Musk. The OpenAI lawsuit will go on.
Musk’s Companies Accused Apple of Limiting Competition
The lawsuit claimed that Apple falsely favoured OpenAI through its use of ChatGPT in Apple Intelligence features on iPhones and other Apple devices.
X and SpaceX AI claimed that the arrangement effectively put ChatGPT at an advantage over competing AI services, some of which Musk’s companies were also working on. They said Apple and OpenAI colluded to protect their monopoly positions in the smartphone and chatbot markets.
Apple has denied wrongdoing. It has also claimed its integration with OpenAI on its devices is non-exclusive. The judge ruled in November that the case could proceed, handing an early legal victory to Musk’s companies.
OpenAI Claims It Was Not Included in the Deal
The claims against Apple have been settled, but the matter remains open as far as OpenAI. Meanwhile, in a separate court filing, OpenAI said it was not a party to the agreement between X, SpaceX AI, and Apple. It also said it was unaware of the agreement’s terms and had asked X for a copy.
OpenAI contended that the settlement could impact the other claims remaining in the case and its defence. Apple and OpenAI were not available for immediate comment.
The companies have previously denied Musk’s allegations. Musk has accused Apple of “firing legal bullets” at OpenAI, while Apple insists that its integration with OpenAI doesn’t create barriers to competition for other AI businesses.
Musk’s Wider Fight With OpenAI
The lawsuit comes as part of an ongoing feud between Musk and OpenAI. Musk was an early backer of OpenAI, but later became one of its biggest critics when the company started to go along a more commercial path. Musk has argued that OpenAI abandoned its original goal of creating beneficial AI. OpenAI has rejected his claims.
OpenAI has won another lawsuit brought by Musk in May, who claimed the company abandoned its original mission. Meanwhile, Musk’s AI company xAI is expanding. xAI purchased X for US$33 billion last year.
