Walmart Escapes Billions in Potential Opioid Penalties With $50M Settlement

America’s largest retailer has agreed to pay $50 million to settle one of the US government’s biggest lawsuits stemming from the opioid epidemic, resolving allegations that its pharmacies unlawfully dispensed prescriptions while Walmart denied liability and described the payment as immaterial.

Walmart opioid settlement terms will see the retailer pay $50 million to settle a lawsuit by the US government, which alleged that its pharmacies unlawfully filled thousands of invalid prescriptions for opioids and other controlled substances.

The agreement came out of the US Department of Justice on Aug. 28. The lawsuit, filed in December 2020, could have left Walmart liable for civil penalties of billions of dollars.

Walmart has not admitted that it was at fault and the settlement does not find the company to be at fault. In a regulatory filing, it called the $50 million payment “insignificant.”

Federal Case Focused on Prescription Red Flags 

Wal-Mart was accused by the government of violating the Controlled Substances Act in 2013 for not identifying, monitoring or reporting suspicious opioid prescriptions.

Some prescriptions had red flags such as suspected prescription drug “pill mills,” dangerous drug combinations, high doses or early frequent drug refills, according to the Justice Department.

The deal calls for further restrictions at Walmart's stores and pharmacies. This includes more stringent regulation of pharmacists as well as a hotline for staff and patients to report suspected illegal dispensing.

Walmart will also have to keep track of the dispensing patterns and evaluate the prescribers that are suspected of illegal prescribing. The updated Walmart opioid settlement resolves the federal lawsuit which was narrowed in 2024 when a court tossed some claims but preserved others.

Settlement Follows Earlier $3.1 Billion Agreement 

The new Walmart opioid settlement is not part of a 2022 agreement between Walmart and the state to pay $3.1 billion to settle thousands of opioid-related lawsuits.

The previous deal included every state in the USA, the District of Columbia, Puerto Rico and three other US territories, but also eligible local governments and federally recognised Native American tribes.

The new settlement is for a U.S. federal case, and does not include claims from other nations such as Australia. The case brings to an end a series of cases brought by Australian and US businesses against the leading dispensing companies that involves the controlled dispensing of such drugs.

Walmart's net income in the six months that ended on July 31 was $11.7 billion, in its last financial disclosures mentioned in the settlement report.

The health picture is still strong. In May, provisional data from the Centers for Disease Control and Prevention (CDC) indicated that the number of opioid-involved overdoses in the United States dropped from 55,296 in 2024 to 44,564 in 2025.
