In disclosures made in a courtroom in California on Monday, Greg Brockman, co-founder and president of OpenAI, revealed that his ownership stake at the AI research firm was valued at around $30 billion, an amount never disclosed before. The revelation came when questioned by a lawyer for Elon Musk, who co-founded OpenAI and is now taking the company to court for changing from a non-profit to a profit-making one. 

Brockman also revealed that he took $10 million worth of a stake in Altman’s personal family office in 2017, as well as ownership stakes in Cerebras, an AI chip startup and Helion Energy, a fusion company where Altman has invested hundreds of millions of dollars. This week marks the second week of a trial that could spell the end for one of the world’s biggest companies.

In their court filings, Musk’s lawyers contend that Brockman’s financial ties to Altman were not only rare, but also involved a conflict of interest in key decisions, such as the 2019 move of OpenAI to become a principal for-profit firm. 

Emails entered into evidence at the trial indicate Musk’s head of family office, Jared Birchall, warned him in writing that Altman’s compensation arrangement with Brockman meant “Greg is going to have a heightened loyalty to Sam as a result of this arrangement.” Musk sent that email to Brockman with nothing but “??” At the same time as OpenAI planned an acquisition of the chipmaker, Brockman disclosed he owned shares in Cerebras, a direct conflict his legal team raised in court. Musk seeks $150 billion and the removal of Altman and Brockman from their positions at OpenAI.

OpenAI Strikes Back, Claims Musk Seeks Control for Own Benefit 

OpenAI outright rejected the allegations, suggesting Musk is motivated by a desire to dominate an industry he co-founded in 2018 and is resentful of being left behind. The litigation was made to help xAI, a rival AI company that, unlike OpenAI, is far less popular in user adoption, and Musk did not prioritise safety while on the board, according to the firm. 

Musk claims that Altman and Brockman earned his $38 million in donations by offering to establish a nonprofit devoted to safe AI development, now shifting gears to create a for-profit company for their personal enrichment, including breach of charitable trust and unjust enrichment. OpenAI has been funded by many investors to the tune of well over $100 billion since officially releasing ChatGPT in 2022 and looks on track for a (potential) Trillion Dollar IPO.
