H-1B is a non-immigrant visa that allows American companies to employ foreign workers for special occupation. It is a program that provides 65,000 visa annually and an additional 20,000 visa to people with very advanced degrees.

These have a validity of three to six years and are predominantly used by tech firms. The new fee of $100,000 did not apply to foreign nationals present in the United States already on student visas, a category that represents a large portion of H-1B recipients every year.

The White House has expressed confidence the ruling will be overturned after appeal. According to White House spokeswoman Taylor Rogers, the administration believes that the president has unambiguous legal power to limit the arrival of foreign nationals when it is in America's interests.

Through Feb. 15, USCIS had received only 85 payments of the $100,000 fee, as of a March court filing and said there is little evidence that the policy has been used much at all since its introduction.
