DOJ Decision to Drop Adani Case Faces No Challenge From US Prosecutor

Synopsis

The senior federal prosecutor overseeing the case has told the court he will not contest the Justice Department's decision to end the prosecution.

The Justice Department's bid to end the Adani case won't be objected by anyone except by the top federal prosecutor overseeing the probe as the government's request gets a step closer to a final judicial approval. 

U.S. Attorney Joseph Nocella Jr. wrote to Judge Nicholas Garaufis, noting that he had no reason to object the explanation provided by the Justice Department officials behind the Justice Department's move to end prosecution.

The filing comes after the court asked questions after the Justice Department had submitted requests to dismiss the criminal allegations against Indian businessman Gautam Adani and his nephew Sagar Adani. The prosecution is seeking dismissal of the case with prejudice, meaning that if the court agrees to such requests, it could not re-prosecute them again.

Court Weighs Government's Request 

The Justice Department has stated it's not in its enforcement interest to further pursue the case and has stated that the alleged violations were primarily based outside of the United States. This, according to the Justice Department, made pursuing the case difficult based on current policy.

Adani's legal representatives have refuted all allegations and claimed the Justice Department's decision is completely separate from the reported plans of the group to invest US$10 billion in the United States. According to court documents, no agreement or 'quid pro quo' was behind the Justice Department's move.

The move by the Justice Department to discontinue the Adani case follows allegations of bribing Indian officials in exchange for contracts to build solar power projects and making false claims to US investors to raise funds through these contracts. Adani has repeatedly denied any wrongdoing.

The probe is also gaining attention from Australia, where the Adani Group owns Bravus Mining & Resources and operates the Carmichael coal mine, one of the country's largest thermal coal projects in Queensland.

GQG Partners, a listed investment manager from Australia, is also one of the largest shareholders of the Adani Group and developments in this investigation are relevant to investors considering exposures to companies linked to the Adani Group.

The Adani Group is one of India's largest infrastructure firms with diverse business interests including ports, airports, logistics, power, utilities, and mining in India, Australia, Sri Lanka, Israel and Tanzania. The group’s listed companies' disclosed financials for the financial year 2024-25 showed a combined revenue of 2.72 lakh crore (about $32 billion).

Judge Garaufis is yet to rule on the application for the dismissal of Gautam Adani’s DOJ case.
