OpenAI has asked a US judge to dismiss Apple’s lawsuit, which accuses the ChatGPT maker and two former Apple employees of taking trade secrets to help develop consumer hardware.
In a court filing submitted on Wednesday, OpenAI said it has “no use, need or desire” for Apple’s trade secrets. “OpenAI is building something entirely new and different from anything at Apple,” the company said in its motion.
OpenAI Pushes Back Against Apple’s Allegations
Apple filed the lawsuit in July, alleging that OpenAI obtained and used its confidential information through former employees, hiring practices and supplier relationships to accelerate its consumer hardware efforts.
OpenAI argued that Apple’s complaint does not clearly identify the specific trade secrets it claims were misappropriated.
The company also said Apple had failed to demonstrate that it owned any legally protectable trade secrets or that OpenAI or the other defendants had improperly used them.
OpenAI further argued that Apple should not be allowed to rely on what it described as a “baseless and pretextual lawsuit” to compensate for its own challenges in recruiting and retaining talent or integrating AI into its products.
Existing Partnership Continues
The legal dispute comes as both companies compete to develop AI-powered consumer devices that could reduce reliance on traditional apps and operating systems.
Despite the lawsuit, Apple and OpenAI continue to work together through their existing partnership, which allows Siri to provide ChatGPT-powered responses. iPhone users can also subscribe to ChatGPT directly through the iOS Settings app.
